1. General

Miss Florenski operates within the United Arab Emirates and provides luxury floral arrangements, flower boxes, gifts, and related products. By using our website or placing an order, you confirm that you are at least 18 years old or have obtained consent from a parent or legal guardian, all information provided is accurate and complete, and you are legally capable of entering into binding agreements. Miss Florenski reserves the right to amend these Terms & Conditions at any time without prior notice. Updated versions shall become effective immediately upon publication on this website.

2. Product Availability

Fresh flowers are seasonal and natural products. While we make every effort to reproduce arrangements as displayed on our website, slight variations may occur due to seasonal availability, natural differences in flower size and color, market supply conditions, weather conditions, and import restrictions. Where substitutions are necessary, flowers of equal or greater value and similar style shall be used. Such substitutions shall not constitute a defect, error, or basis for compensation.

3. Product Images

Product photographs are intended as representations only. Because fresh flowers are natural products, no two arrangements are identical. Minor differences in bloom size, flower opening stages, colors, shapes, ribbon styles, and packaging details shall not be considered defects or grounds for refunds.

4. Pricing

All prices displayed are in UAE Dirhams (AED). Miss Florenski reserves the right to modify prices without notice, correct typographical or pricing errors, and cancel orders affected by pricing inaccuracies. In the event of an obvious pricing error, Miss Florenski reserves the right to cancel the order and issue a full refund.

5. Orders

All orders are subject to acceptance and availability. Miss Florenski reserves the right to refuse or cancel any order at its sole discretion, including but not limited to cases of suspected fraud, incorrect pricing, payment authorization failure, product unavailability, incomplete delivery information, or situations beyond our reasonable control.

6. Delivery

Delivery times are estimates only. While every effort is made to deliver within the selected time window, Miss Florenski shall not be liable for delays caused by traffic conditions, weather, public holidays, building access restrictions, incorrect addresses, recipient unavailability, or events outside our reasonable control. Delivery shall be deemed completed when the order is delivered to the recipient, a family member, reception, security personnel, a concierge, a neighbor, or any person reasonably present at the delivery location. Photographic proof of delivery may be retained for verification purposes.

7. Incorrect Addresses

Customers are solely responsible for providing accurate delivery information. If the address is incorrect, contact numbers are unavailable, the recipient cannot be reached, or access is denied, Miss Florenski reserves the right to charge additional delivery fees, reschedule delivery, or cancel the order without refund where the product has already been prepared or dispatched.

8. Recipient Unavailability

If the recipient is unavailable at the delivery address, Miss Florenski may leave the order with security or reception, leave the order with another person present, attempt to contact the recipient, or return the order to our premises. Additional delivery charges may apply for redelivery. Miss Florenski shall not be responsible for deterioration in quality resulting from delayed acceptance by the recipient.

9. Perishable Nature of Products

Fresh flowers are highly perishable products. Customers acknowledge that flower longevity depends on environmental conditions, temperature, handling after delivery, flower varieties, and care provided. Miss Florenski cannot guarantee a specific vase life or blooming period. Natural wilting, color changes, and aging are not defects.

10. Force Majeure

Miss Florenski shall not be liable for delays, failures, or inability to perform arising from events beyond its reasonable control, including acts of God, floods, fires, pandemics, government restrictions, transportation disruptions, import limitations, strikes, or technical failures.

11. Intellectual Property

All content appearing on this website — including photographs, product images, logos, text, descriptions, designs, graphics, and branding elements — are the exclusive property of Miss Florenski and are protected under applicable intellectual property laws. No content may be copied, reproduced, distributed, modified, or used without prior written permission.

12. Limitation of Liability

To the fullest extent permitted by law, Miss Florenski shall not be liable for indirect losses, consequential damages, emotional distress, loss of profits, loss of business opportunities, delays caused by third parties, or events beyond our reasonable control. Our maximum aggregate liability arising from any order shall not exceed the purchase price paid for that specific order. Nothing in these Terms excludes rights that cannot legally be excluded under applicable UAE law.

13. Third-Party Platforms

Orders placed through third-party marketplaces or platforms are additionally subject to the terms and policies of those platforms. Miss Florenski shall not be responsible for website outages, payment failures, delivery delays, or technical issues caused by third-party service providers.

14. Customer Conduct

Customers agree not to misuse the website, attempt unauthorized access, submit false information, engage in fraudulent activities, or interfere with website functionality. Miss Florenski reserves the right to suspend or refuse service where misuse is suspected.

15. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Dubai, United Arab Emirates.

16. Severability

If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
